Preface
In accordance with the provisions of DL No. 24/2014, of February 14, and Law No. 94/96, of July 31, this document establishes the terms and conditions to be observed when using the website www.joannastore.pt. , as well as in the process of purchasing the products sold there, made available to its users.
Therefore, users of the website must carefully read the conditions and privacy policy before using it, since by using it or placing an order, users are consenting to be bound by these conditions.
In case of disagreement with these conditions and privacy policy, users must not use the website www.joannastore.pt .
These terms and conditions may be changed freely and without prior notice to comply with applicable law. Therefore, users are responsible for periodically reviewing the Privacy Policy and General Terms and Conditions, as they will comply with the provisions in effect at the time of use of the website and at the time of suspension of the contract (as defined herein).
These general terms and conditions of sale are agreed between Joanna Patricia Ribeiro Unipessoal Lda., with registered office at Rua Lúcia Lousada, 267, 4620-030 Lousada, with NIF 517 043 661, hereinafter “Joanna Store” and any user who wishes to make a purchase through the website www.joannastore.pt , hereinafter “User”.
1st Order
1st The user may place the order through the website www.joannastore.pt , filling in all required fields and providing your personal data. By doing so, the user expresses full and complete access to the general terms and conditions of sale, prices, and features of the products included in the order. All orders are subject to Joanna Store's accessibility.
2. Orders are subject to stock availability. Joanna Store will notify the user if the products ordered are out of stock, or if the order cannot be fulfilled for any other reason. In this case, Joanna Store will refund any amounts paid, as set forth in Article 19 of DL No. 24/2014, of February 14.
3rd Joanna Store reserves the right to, at any time, withdraw any product from the website www.joannastore.pt , as well as to suppress or alter any material or content, not being responsible for such fact, before the user or third party, as well as for the unavailability of the product, under the terms referred to in clause 2 of this article.
2nd Order Execution
1. After confirmation of full payment for the products, as well as shipping costs, and without prejudice to the provisions of clauses 2 and 3 of article 1, the order will be completed within 30 days.
3rd Shipping cost
1. When making a purchase at the Joanna Store online store, you can choose one of two methods to access your order: pick up in store or send to the address indicated.
2nd Delivery of orders to the store does not involve any shipping costs.
3. Delivery of orders to the user's home, or to an address indicated by the user for this purpose, will imply that the user will be obliged to bear the delivery costs, depending on the value of the products ordered and depending on the area, under the following terms:
We only deliver orders in Portugal and Spain.
4th Price and payment
1st In accordance with current legislation, personalized prices on the website www.joannastore.com.br , must be understood in euros, with taxes and fees included, on the date of issue of the corresponding invoice.
2. The applicable ICMS rate will be that in force in the Member State of the place of delivery, in accordance with the orders placed.
3. Prices and specifications are subject to change without prior notice.
4º Joanna Store declines any responsibility for any errors published on the page www.joannastore.pt .
5th If the actual price of the ordered product is higher than that shown on the page, the user will be contacted to accept or cancel the order.
6th In the event that the actual price of the product ordered is lower than that shown on the website www.joannastore.pt , the difference between the actual value and the amount paid will be returned to the user.
7º The user may use the following payment methods: Multibanco, MB WAY, and Credit Card.
5th Transfer of risks
Product risks will be assigned to the user's cargo from the moment of delivery.
6th Right of Withdrawal and Return
1st The user may cancel the order, without giving a reason, within 14 days of the order data, with a refund of the amount paid.
2. Shipping and return costs are the responsibility of the user. Therefore, in the case of cash on delivery, Joanna Store may charge the user for any expenses incurred.
3. The right to withdraw may be exercised by the user in any way permitted by law, and shall be considered, in any case, validly exercised by sending the withdrawal information.
4. This provision does not affect other rights granted to consumers by current legislation.
5. The right of withdrawal applies exclusively to products that can be returned in the same conditions in which the user received them, especially in the original packaging and with all documents.
6. After the return, Joanna Store will inspect the products and check their condition. If the products have been used beyond simply opening the packaging, or if they are damaged, a refund will not be issued.
7º Responsibility for damage suffered by products or their loss during return is the sole responsibility of the user.
8th The intention of resistance can be expressed through the email geral@joannastore.te .
7th Defective products
1. If, at the time of delivery of the product, the user considers that it does not comply with the provisions of the order, he/she must immediately contact Joanna Store.
2nd The collection of the product that does not comply with the conditions of the contract will be carried out by Joanna Store, which will examine the product and, if non-compliance is confirmed, will notify the user by email or telephone that the product will be replaced within a reasonable period of time.
3rd The replacement of the product will, however, be subject to stock availability.
4. If replacement is not possible, the amount paid for the products will be refunded to the user, including delivery costs.
8th Refund of amounts paid
The refund of amounts paid, in cases of exercising the right of withdrawal and for defective products, will be processed through the same method that was used to make the payment, within 14 days.
9th Exchanges
Products purchased on the website www.joannastore.com.br can be exchanged.
If the user wishes to exchange their item for any reason, simply contact the customer support team and inform them of this intention within 14 business days of placing the order.
1st The items available on the website must be checked to make the exchange.
2. As with return processes, items must meet certain condition conditions, namely:
The item must be in perfect condition, with no signs of use or any visible damage;
You must ensure that the item comes with the original tag and, if applicable, branded accessories;
Keep the original bag/box with the shipping label. If you don't have it, write your name or order number inside the bag.
10th Right of free resolution
The user has the right to freely terminate this contract within 14 calendar days, without needing to provide any reason.
The deadline for exercising the right of free termination expires 14 days from the day following the day of suspension of the contract.
In order to exercise your right to free resolution, the user must contact us at Joanna Patricia Ribeiro Unipessoal Lda., Rua Lúcia Lousada, 267, 4620-030 Lousada, telephone +351 916 933 648, email geral@joannastore.te your decision to withdraw from the contract by means of an unequivocal statement by registered letter sent by post or to the email geral@joannastore.te .
For the free resolution period to be respected, it is sufficient that the communication regarding the exercise of the right of free resolution is sent before the resolution period expires.
11th Effects of free resolution
In the event of termination of this contract, the user will be refunded all payments for these incidents, including delivery costs (except for additional costs resulting from the choice of a shipping method other than the least expensive standard shipping method offered by us), without undue delay and, in any case, no later than 14 business days from the date on which we are informed of your decision to terminate this contract. Refunds will be made using the same payment method used in the initial transaction, unless expressly agreed otherwise by the user; in any case, the user will not incur any costs as a result of such refund.
The refund may be withheld until terms have been received for the returned goods, or until you provide proof of having sent the goods, whichever comes first.
In the event of termination of the contract, the user must return the item(s) to Joanna Store without undue delay and no later than 14 days from the day on which the user informs us of the termination of the contract. The deadline is deemed to have been met if the user returns the items before the 14-day period.
The costs of returning the goods will be borne by you.
The user is only responsible for the depreciation of the goods resulting from handling that goes beyond what is necessary to verify the nature, characteristics and functioning of the goods.
12th Responsibility
1st For all steps to access the page www.joannastore.br, as well as the ordering process, delivery and subsequent services, Joanna Store has only a means obligation.
2nd Joanna Store does not guarantee nor is it responsible for any inconvenience or damage caused by the use of the internet network, service interruption, external invasion or presence of computer viruses, or any other case of force majeure.
3rd The products will be described and presented on the website www.joannastore.com.bras accurately as possible. If errors still occur on the website www.joannastore.pt, Joanna Store is not responsible for such fact.
4th The provisions herein do not affect the rights granted to users in relation to the duration of the contract.
13th Processing of personal data
1. The information or data provided by users will be treated in accordance with the provisions of the Privacy Policy.
2nd When using the website www.joannastore.br, the user consents to the processing of the information and data referred to in the preceding paragraph and declares that all information provided is true and corresponds to reality.
3rd Personal data will be used by Joanna Store for information, dissemination and order processing actions.
4. The user is guaranteed the right to access, rectify, change or delete their personal data, simply by sending an email to geral@joannastore.te .
5. Although Joanna Store collects and processes data securely and prevents loss or manipulation, using the most advanced techniques for this purpose, we inform you that collection on an open network allows the circulation of personal data without security conditions, running the risk of being viewed and used by unauthorized third parties.
14. Viruses, hacking and other computer attacks
Joanna Store is not responsible for any damages or losses resulting from a denial of service attack, viruses or any other technologically harmful or damaging program or material that may affect the user's computer, computer equipment, electronics, data or materials, as a result of the use of the website www.joannastore.co.uk, or downloading content from the same or from the content to which the same redirects.
15th Intellectual property
1st All elements, whether sound or visual, of the website www.joannastore.pt , including the underlying technology, are protected by copyright, trademark or patent.
2nd The user who has a personal website and who wishes to place, for personal use, on his website a simple direct link to the page www.joannastore.pt, you must request prior authorization from Joanna Store. Authorization is only valid if provided in writing.
3rd Any link or hypertext directed to the website www.joannastore.br, using framing or in-line linking techniques is formally prohibited.
4th In all cases, the use of any link, including those referred to in 2nd and 3rd hereof, even if authorized, must be removed with a simple request to Joanna Store.
16th Total Agreement
These general terms and conditions of sale constitute the entire agreement between Joanna Store and you. If any of the clauses of these terms and conditions becomes null and void due to a change in legislation, regulations, or a court ruling, it will be deemed unwritten.
17 Unilateral amendment of these conditions
1. These terms and conditions may be changed at any time. The user is subject to the policies and conditions in effect at the time of using the website www.joannastore.pt. or formalize your order, except when, by law or decision of government bodies, changes are made retroactively.
2. In the case provided for in the second part of the previous paragraph, the changes will also affect orders that the user has formalized under the conditions subject to change.
18th Applicable legislation and jurisdiction
These terms and conditions are governed by Portuguese law. Any dispute arising from these terms and conditions will be submitted to the competent Portuguese court.
